This Internet Services Agreement (this ‘Agreement’) is between Dinoaxis, an hosting service provider “Brand” operated by Good Software Technology Sdn Bhd and the person (individual or legal person) who agrees to Dinoaxis’s service and set up form (the ‘Order’) incorporating this Agreement by reference (‘Customer’). This Agreement governs Customer’s use of Dinoaxis’s Internet services.

Intellectual Property

Your acknowledge that Dinoaxis is the exclusive Intellectual property of Good Software Technology, and can only be used with explicit permission of Good Software Technology's Sdn. Bhd. You're agreed to taking all reasonable steps to ensure that Dinoaxis IP is used in a way that does not affect either the validity of such Dinoaxis IP or Good Software Technology Sdn. Bhd ownership of Dinoaxis IP in any way.

Copyright

Dinoaxis respect the intellectual property rights of others and we ask our users to do the same.

Customer Responsibility

Each Dinoaxis customer is responsible for the activities of its users and, by accepting service from Dinoaxis, is agreeing to ensure that its customers/representatives or end-users abide by this Policy. Customer should maintain their own data (e-mail, CMS; Content management system, Database and etc) which hosted on Dinoaxis’s infrastructure according to law of Malaysia. Complaints about customers/representatives or end-users of an Dinoaxis customer will be forwarded to the Dinoaxis customer’s registered admin for action. If violations of the Dinoaxis Acceptable Use Policy occur, Dinoaxis reserves the right to terminate services with or take action to stop the offending customer from violating Dinoaxis’s AUP as Dinoaxis deems appropriate, without notice."

No Outside Food Policy

1. Customer may only utilize service that offered by default/subscribed as add on which offered via our websites only.
2. Integration of 3rd party add-on service which doesn't offered by Dinoaxis
3. Customer are required to use our Nameservers or our partners Nameservers which customer subcribe through Dinoaxis to enable their subcription.

Payment

Method

Dinoaxis accept payment only through our website.

Tax
At Dinoaxis’s request Customer shall remit to Dinoaxis all sales, service or similar tax imposed on the provision of the services (but not in the nature of an income tax on Dinoaxis), regardless of whether Dinoaxis fails to collect the tax at the time the related services are provided. Customer will pay and indemnify and hold Dinoaxis harmless from any and all taxes associated with or arising from Customer’s use of the Services, including any penalties and interest and any costs associated with the collection or with holding thereof.

Disclaimer

This and any other websites hosted by Dinoaxis and all information, products and services on them are provided on an "as is"" basis, without warranty of any kind, either express or implied. Your use of this and any other websites hosted by Dinoaxis is at your own risk. Dinoaxis disclaims all warranties, express or implied, including without limitation, warranties of merchantability and fitness for a particular purpose. Dinoaxis disclaims liability for any direct, indirect, incidental, special, consequential, exemplary, punitive or other damages, or lost profits, that may result directly or indirectly from the use of this and any other service offered by Dinoaxis and any material that is downloaded or obtained through them. This includes, without limitation, any damage to computer systems, hardware or software, loss of data, or any other performance failures, any errors, bugs, viruses or other defects that result from, or are associated with the use of this and any other websites hosted by Dinoaxis.

Backup

Customer agrees to maintain a current copy of all content hosted by Dinoaxis nothwithstanding any agreement by Dinoaxis to provide back up services. Dinoaxis will not be responsible for any loss of data in whole, or part.

Refund

Customer acknowledges that all fees are non-refundable, unless stated explicitly otherwise, and that any attempts to circumvent this policy, whether through eg: credit card chargeback, threat of chargeback or other means, will result in immediate termination of all services, and re-assignment of all customer’s domain names, if any, to Dinoaxis.

Provision and Termination

Dinoaxis via IT automation, will provision your service subscribed (not including domain transfer) in matter of minutes after your invoice is cleared by the payment gateway, and marked as paid.

Your order will be set to cancel automatically within 24hours shall there's no payment made via the client portal

1. Dinoaxis have the ultimate right to terminate subscription of any customer's which not limited to our view that might appear ; violating term and condition of fair use policy, or broke Malaysian national laws without any pior notice.

2. Any party who wish to terminate their susbcription, require to inform Dinoaxis 30 days in advance. Else, any generated invoice, is due immediately upon termination.
